RENTAL AGREEMENT
(Members in Good Standing)
NOTE: NO HELIUM BALLOONS ALLOWED
Know all men by
these presents, that the undersigned (hereinafter whether one or
more being collectively referred to as “lessee”), being a member in
good standing of the Winona Lakes Community, a Pennsylvania
nonprofit Corporation (hereafter referred to as the “Association”),
does hereby agree to rent the Association Clubhouse, located in the
Community, Township of Middle Smithfield, Monroe County,
Pennsylvania (hereafter referred to as the “Premises”) for the
following purpose ___________________________________ (hereafter
referred to as the “Event”) to be held on the ____________ day of
_________________________ (hereafter referred to as the “Date”),
from ( ) a.m., or ( ) p.m. to ( )
a.m., or ( ) p.m. The Lessee does hereby agree to comply
with all of the Rules, Regulations and By-Laws of the Association
with respect to the use of the premises for the foregoing Event,
which Rules, Regulations and By-Laws have been by the lessee.
The lessee shall
pay to the Association the following rental and security deposit
upon submission of the Rental Agreement to the Association:
1) $___________ for the rental of the Clubhouse on
__________________________, 20______ from ( ) a.m., or
( ) p.m. to ( ) a.m., or ( ) p.m.
2) A Security deposit of $___________ which shall be
held by the Association as security for any damage that may be
caused to the Premises or any other property of the Association,
whether real or personal, including but not limited to walls and
doors, light fixtures, kitchen equipment and utensils, furniture,
etc. If there is no loss or damage to the Premises, the deposit
will be returned to the lessee in due course. However, the lessee
agrees that the cost of replacing and/or repairing loss or damage
shall be deducted from the security deposit, and if the loss or
damage is in excess of the amount of the security deposit, the
lessee agrees to pay for any excess upon the demand of the
Association. Also, if additional charges occur during said rental
period and not paid at the end of said rental period. The charges
will be deducted from your security deposit. The balance will be
refunded.
The LESSEE further
agrees that the LESSEE will not assign this Agreement nor underlet
the said Premises or any part thereof, or use or occupy the same
other than for the stated Event, for the named LESSEE only, without
the written consent of the Association first had and obtained.
It is agreed that
the LESSEE shall and will during the said Rental Period, or any
renewal thereof, at their own proper cost and expense, keep every
part and portion of the Premises in good order and repair, and at
the end of said Rental Period, or any renewal thereof, will deliver
said Premises in as good condition as the same were presented. It
is further understood and agreed upon by the Lessee that within
twelve (12) hours after the Event, or within two (2) hours prior to
the next event scheduled at the Premises, whichever comes first, the
Premises including the kitchen shall be returned to the condition as
presented immediately prior to the Event. At the termination of the
Rental Period, Premises must be returned, with all floors broom
swept and/or vacuumed. Lessee is specifically prohibited from
putting nail holes in any wall, or from damaging the Premises in any
way whatsoever. The Lessee shall have and will permit the
Association or Association’s duty authorized employee or agent to
enter the Premises at all times for inspection (or if the
Association shall elect, for making repairs, alterations or
additions or for making alterations, additions, or repairs to the
building of which the Premises may be part.
The Lessee hereby
releases the Association and its members from all responsibilities
and liability and the Lessee specifically assumes all liability in
any action for damages which may arise from any kind of injury
whatsoever that may at any time occur upon the Premises, or that may
arise from any cause whatsoever.
Lessee shall comply
with all requirements of any of the constituted public authorities
and with the terms of any State or Federal Statute or local
ordinance or regulation applicable to Lessee or their use of the
Premises.
Lessee shall keep
the Premises, hallways, corridors, yard and walkways clean and neat
at all times, free of trash and debris.
As a condition for
the rental and use of the Premises, the Lessee agrees to accept and
use the Premises AT HIS OR HER OWN RISK. Therefore the Lessee for
themselves, their heirs executors, administrators, successors and/or
assigns hereby expressly release and forever discharge and further
agree to save harmless, exonerate, defend and indemnify the
Association and its members, agents, servants, employees, directors
and officers from any and all claims, actions, damages, losses,
liabilities and cost whatsoever, including attorney fees, whether
due to negligence or otherwise, for any loss or damage to property
or injury or death to any person, and/or guests and/or invitees
arising from any and all causes whatsoever, including but not
limited to the following:
a)
The
rental or use of, or activities conducted in or about the premises,
it’s faculties or surrounding premises;
b)
The
dispensation, consumption or use of any alcoholic beverages, in/or
about the premises or on Association property or by Lessee or any of
the visitors, guests, and/or other persons in attendance, and at any
violation or breech of the rental agreement or any law, ordinance or
regulation including without limitation, the Pennsylvania Liquor
Control and Regulations promulgated by the Pennsylvania Liquor
Control Board, as amended and supplemented.
The undersigned
acknowledges having carefully read and fully understanding the
Rental Policy, Rental Agreement and the Association By-Laws and
Rules and Regulations, voluntarily signs this Agreement as a free
act and with full knowledge of its significance, and agrees to be
legally bound hereby.

the undersigned Lessee, intending to be legally bound, has executed

Acceptance
The foregoing
Rental Agreement is hereby accepted, subject to the aforesaid terms,
and the Association agrees to be legally bound thereby.
